2. Description of Services
SCOPE Diagnostics provides clinical diagnostic pathology services, including but not limited to:
- Dermatopathology analysis and diagnosis
- Immunohistochemistry (IHC) testing
- Direct Immunofluorescence (DIF) testing
- Fluorescence in situ hybridization (FISH)
- Next-generation sequencing (NGS)
- Digital pathology services
- Electronic medical record (EMR) integration
- Online portals for healthcare providers and patients
3. Medical Disclaimer
Important Medical Information
- Our diagnostic reports are intended for use by qualified healthcare providers in conjunction with clinical examination and other diagnostic information.
- Test results alone should not be used as the sole basis for clinical decisions without consideration of the complete clinical picture.
- Information on our website is for informational purposes only and does not constitute medical advice.
- Patients should consult their healthcare provider for interpretation of test results and treatment decisions.
- In case of a medical emergency, call 911 or your local emergency services immediately.
4. Healthcare Provider Terms
Healthcare providers using our services agree to the following additional terms:
- Ordering Authority: You represent that you are a licensed healthcare provider authorized to order laboratory tests in your jurisdiction.
- Medical Necessity: You certify that tests ordered are medically necessary and appropriate for patient care.
- Patient Consent: You confirm that appropriate patient consent has been obtained for testing and sharing of results.
- Specimen Handling: You agree to follow our specimen collection and handling guidelines to ensure accurate results.
- Result Interpretation: You are responsible for the clinical interpretation and communication of results to patients.
5. Account Registration and Security
To access certain features of our Services, you may need to create an account. By creating an account, you agree to:
- Provide accurate, current, and complete information
- Maintain and promptly update your account information
- Keep your login credentials confidential and secure
- Notify us immediately of any unauthorized access to your account
- Be responsible for all activities that occur under your account

6. Billing and Payment
6.1 Payment Responsibility
Payment for our services may be the responsibility of the patient, insurance company, or referring provider, depending on the arrangement. We will bill in accordance with applicable healthcare billing regulations.
6.2 Insurance
We participate in various insurance networks. Coverage and patient responsibility depend on your specific insurance plan. We will submit claims to insurance on behalf of patients when appropriate.
6.3 No-Surprise Billing
We are committed to transparent billing practices. We comply with the No Surprises Act and will provide good faith estimates for self-pay patients upon request.
7. Intellectual Property
All content on our website, including but not limited to text, graphics, logos, images, software, and the compilation thereof, is the property of SCOPE Diagnostics or its licensors and is protected by United States and international copyright, trademark, and other intellectual property laws.
"SCOPE Dx" and the SCOPE Diagnostics logo are trademarks of SCOPE Diagnostics. You may not use our trademarks without our prior written consent.
8. Permitted Use
You may use our website and Services only for lawful purposes and in accordance with these Terms. You agree NOT to:
- Use the Services for any illegal or unauthorized purpose

Our total liability for any claims arising from your use of the Services shall not exceed the amount you paid to us for the specific service giving rise to the claim during the twelve (12) months preceding the claim.
Some jurisdictions do not allow limitations on implied warranties or exclusion of certain damages, so some of the above limitations may not apply to you.
10. Disclaimer of Warranties
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that our Services will be uninterrupted, error-free, or completely secure. While we strive for accuracy in our diagnostic services, we do not guarantee that all results will be free from error.
11. Indemnification
You agree to indemnify, defend, and hold harmless SCOPE Diagnostics and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your access to or use of the Services, your violation of these Terms, or your violation of any rights of another.
12. Dispute Resolution
12.1 Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Indiana, without regard to its conflict of law provisions.
12.2 Arbitration
Any dispute arising out of or relating to these Terms or the Services shall be resolved by binding arbitration in Indianapolis, Indiana, in accordance with the rules of the American Arbitration Association. The arbitrator's decision shall be final and binding.
12.3 Class Action Waiver
You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.
13. Termination
We may terminate or suspend your access to our Services immediately, without prior notice or liability, for any reason, including without limitation if you breach these Terms. Upon termination, your right to use the Services will immediately cease.
Healthcare providers may terminate their relationship with SCOPE Diagnostics in accordance with any applicable service agreement. We will continue to maintain records in compliance with applicable retention requirements.
14. Changes to Terms
We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to our website. Your continued use of our Services after any changes constitutes acceptance of the modified Terms. We encourage you to review these Terms periodically.
15. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
16. Entire Agreement
These Terms, together with our Privacy Policy and HIPAA Notice of Privacy Practices, constitute the entire agreement between you and SCOPE Diagnostics regarding your use of our Services and supersede any prior agreements.
